Welcome to BestFirenze. These Terms of Service govern your access to and use of BestFirenze.com. By accessing or using the platform, you enter into a legally binding agreement with BestFirenze. Please read these terms carefully. If you do not agree, you must not use the platform.

Acceptance of Terms
By accessing or using BestFirenze.com ('the Platform'), you confirm that you have read, understood, and agree to be bound by these Terms of Service ('Terms') and our Privacy Policy, which is incorporated herein by reference. If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms. BestFirenze reserves the right to modify these Terms at any time in accordance with the provisions set out in Section 13.
Eligibility
You must be at least 16 years of age to register an account or submit User Content on BestFirenze. By using the Platform, you represent and warrant that: (a) you meet this minimum age requirement; (b) you have the legal capacity to enter into a binding contract under applicable law; (c) you are not prohibited from using the Platform under any applicable laws or regulations; and (d) you have not previously been suspended or removed from the Platform by BestFirenze. Access to the Platform for browsing only does not require account registration.
Account Registration & Security
To access features such as saving favourites or submitting reviews, you must register an account. You agree to: • Provide accurate, current, and complete registration information. • Maintain the accuracy of your information and update it promptly if it changes. • Keep your login credentials strictly confidential and not share them with any third party. • Notify BestFirenze immediately of any suspected or actual unauthorised access to your account at security@bestfirenze.com. • Use only one account per person; creating multiple accounts to circumvent restrictions is prohibited. You are solely responsible for all activity that occurs under your account. BestFirenze will not be liable for any loss or damage resulting from your failure to maintain the security of your credentials.
Permitted Use & Licence
Subject to these Terms, BestFirenze grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for personal, non-commercial travel discovery and planning purposes related to Florence, Italy. Permitted uses include: browsing place listings; using search and filter functionality; reading reviews and descriptions; submitting genuine reviews and place suggestions; saving favourites to your account. Any other use of the Platform — including commercial exploitation of our content, data scraping for resale, or systematic extraction of place data — requires BestFirenze's prior written consent.
User Content & Licence Grant
When you submit content to BestFirenze — including reviews, ratings, photographs, comments, or place suggestions ('User Content') — you: • Retain full ownership of your User Content. • Grant BestFirenze a non-exclusive, worldwide, royalty-free, irrevocable, sublicensable licence to use, store, reproduce, modify (for formatting purposes), display, publish, and distribute your User Content in connection with operating, maintaining, and promoting the Platform. • Represent and warrant that you have all rights necessary to grant this licence; that your User Content is accurate and based on genuine personal experience; and that it does not infringe any copyright, trademark, privacy, or other right of any third party. This licence continues even if you close your account, except where you delete specific content before account closure.
Content Standards
All User Content submitted to BestFirenze must comply with the following standards. Content must: • Be truthful, accurate, and based on genuine, first-hand experience. • Not be defamatory, fraudulent, misleading, or malicious. • Not include spam, promotional material, affiliate links, or unsolicited advertising. • Not contain personal data of third parties without their explicit consent. • Not infringe any intellectual property rights or other proprietary rights. • Comply with all applicable laws, including consumer protection and advertising regulations. BestFirenze reserves the right — but is not obligated — to review, moderate, edit, or remove any User Content that, in our reasonable judgment, violates these standards or our Terms, without prior notice to you.
Prohibited Conduct
The following conduct is strictly prohibited and may result in immediate account suspension, permanent banning, and potential civil or criminal liability: • Scraping, crawling, spidering, or otherwise extracting data from the Platform by automated means without BestFirenze's express written permission. • Creating, submitting, or facilitating fake, incentivised, or purchased reviews. • Operating multiple accounts or coordinating with others to manipulate ratings or rankings. • Impersonating any person, business, or entity, or misrepresenting your affiliation. • Transmitting malware, viruses, ransomware, or any other harmful or disruptive code. • Attempting to gain unauthorised access to any part of our systems, servers, or databases. • Using the Platform to send unsolicited commercial communications or to harvest contact information. • Circumventing, disabling, or otherwise interfering with security-related features of the Platform.
Intellectual Property
The BestFirenze name, logo, trade dress, visual design, original written content, code, and databases are owned by BestFirenze and are protected by Italian and EU intellectual property laws, including copyright, trademark, and database rights. Place information incorporated into the Platform may include data sourced from Google Places API, OpenStreetMap contributors, and other public sources, each used under their respective licences. Nothing in these Terms transfers any intellectual property rights to you. You may not copy, reproduce, modify, create derivative works from, publicly perform, publicly display, republish, download, store, or transmit any of our proprietary content without BestFirenze's prior express written consent, except as strictly necessary for your personal use of the Platform.
Third-Party Links & Services
The Platform may contain links to third-party websites, services, and applications — including place websites, online booking platforms, map providers, and reservation systems. These links are provided for your convenience only. BestFirenze does not endorse, control, or assume responsibility for any third-party sites or their content, privacy practices, terms of service, or accuracy. Your interactions with third-party services are governed solely by their own terms. Accessing third-party sites or services is entirely at your own risk, and we encourage you to review their privacy policies and terms before use.
Disclaimers
THE PLATFORM AND ALL CONTENT THEREIN ARE PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BESTFIRENZE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. In particular, BestFirenze does not warrant that: • The Platform will be uninterrupted, error-free, or free of viruses or other harmful components. • Place information — including opening hours, prices, menus, contact details, or availability — is accurate, current, or complete at the time of your visit. • Any specific place will meet your personal expectations or requirements. Place information may change without notice. Always verify critical details directly with the establishment before visiting. Nothing in these Terms affects your statutory consumer rights under EU Directive 2019/771 or applicable Italian consumer law (Codice del Consumo).
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BESTFIRENZE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED €100 (ONE HUNDRED EUROS) OR THE TOTAL AMOUNT YOU HAVE PAID BESTFIRENZE IN THE 12 MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER. IN NO EVENT SHALL BESTFIRENZE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Nothing in these Terms excludes or limits BestFirenze's liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable EU or Italian law, including mandatory consumer rights.
Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless BestFirenze and its officers, employees, and contractors from and against any and all third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your access to or use of the Platform in violation of these Terms; (b) your User Content, including any claim that it infringes a third party's intellectual property or privacy rights; (c) your violation of any applicable law or regulation; or (d) your wilful misconduct or negligence. BestFirenze reserves the right, at its own expense, to assume exclusive defence and control of any matter otherwise subject to indemnification by you.
Governing Law & Dispute Resolution
These Terms of Service are governed by and construed in accordance with the laws of Italy, including applicable EU regulations such as the Digital Services Act (Regulation (EU) 2022/2065) and the Consumer Rights Directive (2011/83/EU). The United Nations Convention on Contracts for the International Sale of Goods does not apply. For disputes arising from these Terms: • Consumers resident in Italy or elsewhere in the EU retain the right to bring proceedings before the competent court of their place of residence, as guaranteed by EU consumer law. • For all other disputes, the courts of Florence, Italy shall have exclusive jurisdiction. • Online Dispute Resolution: The European Commission provides an online dispute resolution platform accessible at https://ec.europa.eu/consumers/odr, which you may use to attempt to resolve disputes out of court.
Termination, Severability & Entire Agreement
Termination: BestFirenze may suspend or permanently terminate your account and access to the Platform at any time, with or without notice, if we reasonably believe you have materially violated these Terms. You may delete your account at any time via your account settings. Upon termination of your account, your licence to use the Platform ceases immediately. Termination does not limit any other rights or remedies available to BestFirenze. Survival: Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive any termination of these Terms. Severability: If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms, without affecting the validity and enforceability of the remaining provisions. Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and BestFirenze with respect to the Platform and supersede all prior agreements, representations, and understandings.
